Advance Notice of Intent to Re-Adopt Emergency Regulations
Consumer Assistance Program Updates

This notice is sent in accordance with Government Code section 11346.1, subdivision (a)(2), of the California Code of Regulations (CCR), title 1, section 52, which require State of California agencies to give at least five (5) working days advance notice of intent to re-adopt emergency regulations with the Office of Administrative Law (OAL). The Bureau of Automotive Repair (Bureau) intends to file a request for re-adoption of the Consumer Assistance Program Updates regulations originally approved by OAL on August 31, 2020, and that became effective that same date. After submission of the full proposed re-adoption of emergency rulemaking file to OAL, OAL shall post notice on its website and allow interested persons five (5) calendar days to submit comments on the proposed emergency regulations as set forth in the Government Code section 11349.6.
Pursuant to CCR, title 1, section 52, subdivision (b)(1), the Bureau has made substantial progress and proceeded with diligence to comply with Government Code section 11346.1, subdivision (e), by undertaking the following activities:
- The Bureau has worked diligently to make permanent the Consumer Assistance Program Update emergency regulations that were approved by OAL on August 31, 2020. The Bureau has obtained preliminary approval of the Certificate of Compliance package by the Department of Consumer Affairs (DCA) Regulations Unit, Budget Office, and Director. The Certificate of Compliance Package is pending review and approval by the Business, Consumer Services, and Housing Agency.
- The Bureau has further consulted the DCA Regulations Unit, and it was recommended the Bureau submit an emergency re-adopt action to extend the effectiveness of the emergency regulations and to allow adequate time for final review of the Certificate of Compliance package.
As required by CCR, title 1, section 52, subdivision (b)(3), the Bureau is submitting an updated Finding of Emergency, herewith, to reflect circumstances that have changed since the initial adoption of the Consumer Assistance Program Update emergency regulations by OAL and demonstrate that the emergency still exists. The Bureau hereby incorporates OAL file number 2020-0820-01ER. The Bureau plans to file the Re-Adoption of Consumer Assistance Program Updates with OAL at least five (5) working days from the date of this notice. If you wish to comment on the Re-Adoption of the Consumer Assistance Program Updates Emergency Regulations, both the Bureau and OAL must receive comments within five (5) calendar days of the Bureau’s filing with OAL. During an emergency filing of proposed regulations, it is the Bureau’s discretion to respond to any public comment received in the five (5) day public comment period.
