Update on citation and remedial training programs

Pursuant to Assembly Bill 471 (Low, Chapter 372, Statutes of 2021), the Bureau of Automotive Repair (BAR) has made significant progress in the implementation of citation and remedial training programs for automotive repair dealers (ARDs). These programs, which became effective on July 1, 2023, offer ARDs the opportunity to address minor violations, improve their understanding of BAR regulations, and ultimately strengthen consumer protection through increased compliance.

Citations issued

Since the programs began, BAR has issued 53 citations to ARDs for a range of violations under the Automotive Repair Act. These violations include but are not limited to:

  • Failure to produce records
  • Failure to meet estimate and invoice requirements
  • Failure to properly document additional authorization
  • Failure to follow specific trade standards

Remedial training

The remedial training program provides a corrective pathway for ARDs cited for violations deemed minor in nature, such as documentation or record-keeping errors. ARDs who opt for this program can complete a BAR-approved remedial training course to prevent their citation from being publicly disclosed. The program is designed to be educational rather than punitive, giving ARDs the chance to strengthen their knowledge of BAR laws and regulations and foster long-term compliance.

To date, BAR has received 14 requests from ARDs to enroll in the remedial training program. Of these, seven have successfully completed the training, four have failed to complete the training, and three are still in progress.

Citation review panel

BAR has also established a citation review panel. The panel provides ARDs with an informal appeal process for citations issued under the Automotive Repair Act. A three-member panel is composed of representatives offering diverse perspectives, including a:

  • BAR representative
  • Member of the public
  • Representative of the automotive repair industry

Since June 2024, BAR has conducted two citation review conferences. The first was held on June 27, 2024, with four citation appeals presented before the panel. A second conference was held on August 8, 2024, during which four additional appeals were considered. The panel’s recommendations were reviewed by the Bureau chief or their designee, who then decided to affirm, modify, or dismiss the citations. This process offers ARDs a fair and efficient way to resolve citation disputes. ARDs can still request a formal administrative hearing if they disagree with the BAR’s decision.

Looking ahead

BAR remains committed to the continued success of these programs. ARDs are encouraged to take advantage of these educational opportunities to resolve citations. BAR will continue to schedule citation review conferences as needed to ensure a transparent and timely process for addressing citations.
